(i) Disclaimer for Services Involving Energy Modalities:

By attending the session, you certify that you have read and agreed to the following disclaimer. A Spinal Energetics session may involve physical movements.

In any physical activity, the risk of injury, even disabling, severe or fatal, is always present and cannot entirely be eliminated. In the case of the experience of any pain, you are instructed to discontinue the activity and ask for support from the facilitator. Please remember to continue to breathe smoothly.

You assume all and complete responsibility for any damages which may occur through participation. Spinal Energetics is not a substitute for medical or psychological attention, examination, diagnosis or treatment. Spinal Energetics is not recommended or safe for those prone to mania, delusion or psychosis.

By registering for a Spinal Energetics session, you affirm that you are in good health and physical and mental condition to participate in such a programme.

In addition, you will make the facilitator aware of any medical conditions and physical limitations before class. The process is not recommended through pregnancy. You also affirm that you are responsible for deciding whether to practice aka and participate at your own risk. You at this moment agree to release and waive any claims you have now or may have against Spinal Energetics and its instructors.

By attending the session, you hereby affirm that you have read, understood and agree with the terms and conditions of this disclaimer and that you certify that you are responsible for your own health, mental well-being, decisions and actions as a result of the session and the process.

The results may vary from participant to participant. I do not offer any legal, medical, psychological or other professional advice. For any such advice or help, we recommend contacting a licensed professional.

Contraindications

If you have any of the below conditions, please contact me via email before booking a session:

  • Significant mental health conditions
  • Cardiovascular problems/history of heart disease
  • History of seizures or aneurysms
  • Severe Asthma
  • Hospitalisation for any psychiatric condition, emotional crisis or spiritual emergence within the last 3 years.
  • Recent surgery
  • Recent injuries or fractures
  • Heavy medications that alter brain chemistry
  • Diagnosed with severe PTSD
  • Any other medical, psychiatric or physical conditions that may impair or affect your ability to engage in activities involving intense physical and/or emotional release

I am formally qualified and trained in the fields of counselling, somatic practices, and yoga, but I am a continuous learner. I take reasonable care and due diligence to commit to best practice. I integrate various modalities, which allows me to offer the best possible service to you.

You are responsible for your own safety and well-being. It is your responsibility to commit to the programs you enrol in and do the work involved to achieve your desired outcomes. As your therapist, I am your guide but I cannot do the work for you. I will guide, support and provide direction, but the ultimate responsibility for the outcomes you achieve, lies with you. Ultimately, the results you achieve will be a reflection of the time and work commitment you put into these programs.

10. Important Information

It’s important you take ownership of your own healing journey when working together, instead of expecting me to wave a magic wand and deliver a quick fix.

Healing from past trauma and growing your capacity to engage in life takes time so it’s important you’re patient and that you do the work. What you put in, you’ll get out but you’ll only achieve the results you seek if you dedicate yourself to attending the sessions, doing your homework and challenging yourself. The more you immerse yourself in the homework, the better prepared you’ll be for achieving your goals and desired outcomes for your mental health and wellbeing.

11. Waiver of Liability

I do not make any guarantees or warranties about the accuracy of any material displayed on this website, with the exception of any non-excludable consumer guarantees and other consumer protection provisions set out in the Australian Consumer Law. I am human and errors creep in despite the best of intentions. If you see something that doesn’t seem right, please let me know.

Some services on this site may be offered for instant purchase.

I accept credit card payments via Stripe. I personally do not have access to your credit card details. If you’re paying via Stripe, it’s up to you if you’d like your credit card details to be kept by the service provider for future convenience, or not. Simply select the relevant option suitable for you during payment.

You may choose to pay for your purchases using EFT deposit to my bank account. EFT is preferred from Australian customers to avoid fees.

14. Cancellations and rescheduling

A minimum of 24 hours notice is required to cancel or reschedule appointments to avoid cancellation fees. My cancellation fees are as follows:

      • 24+ hours notice: No fee
      • 0–24 hours notice: Full fee

This policy supports me in making therapy accessible for clients. This applies to online and in-person appointments.

I do not offer a refund, so you are encouraged to consider carefully whether a purchase is right for you before you make your payment. However, please email me at hello@almabrock.com.au within 24 hours of purchase so we can endeavour to discuss your concerns and attempt to find a mutually acceptable solution.

16. Minor problems

I consider it to be a minor problem if either of our internet access drops out during a call and either or both of us are unable to complete the call. In this instance, I will seek to reschedule to a time that is convenient for both of us.

I also consider it to be a minor problem if either of us become ill and cannot attend a session. I request you please provide me with at least 24 hours notice and I will do the same for you. If either of us are unable to attend due to an unexpected emergency, we agree to let one another as soon as possible. I am happy to postpone sessions when I receive notice at least 24 hours upfront or if there is an emergency that needs to be attended to immediately. However, please be aware that I reserve the right to forgo the full fee or commitment of missed sessions or sessions that are cancelled at the last minute.

17. Major problems

I consider it to be a major problem if you have a long period of illness, the need to care for a family member, or another unforeseen event where you have to pause our work together for an extended period of time. I reserve my right to not provide a refund. Alternative options will be arranged at my discretion, and while I will try to accommodate you, this cannot be guaranteed.

If you feel there is a major problem with any product or service I have provided, please contact me to discuss the issue at an early stage.

18. Limitation of Liability

I take my obligations under Australian Consumer Law seriously and will do my best to address any issues that arise. However, even if there is a major problem, my liability is strictly limited to:

      • providing the services again; or
      • if I am unable to do so within a reasonable time, paying the cost of having the relevant services supplied to you again.

I reserve the right to delete any comments on my website or social media accounts which are rude, offensive or which I deem to be unacceptable. Keep it polite and play nicely, please!

In any of my group programs please choose carefully what you share with the group, how you comment on experiences that others choose to share and respect the privacy and confidentiality of all members by not sharing anything that you hear outside the group.

21. Dispute Resolution & Jurisdiction

(i) Negotiation
If you have any concerns, issues or complaint arising out of your use of this website, my programs or services, or these terms and conditions, you agree to communicate with me with the intention of making a genuine effort to seek a win/win solution, and trying to resolve the dispute in good faith through negotiation and discussion. (ii) Mediation
“We” below refers to everyone involved in the dispute.

If the dispute cannot be resolved by negotiation and discussion within 14 days, we agree to proceed to mediation with the assistance of an independent accredited mediator, seeking mediation online or by telephone if we are not both geographically located within 100kms of each other.

The mediator is to be appointed by agreement between us or, failing agreement within 21 days of the negotiation period ending, the person initiating the dispute will seek the appointment of a dispute resolution professional by the President of the Law Society of Victoria or similar neutral authority.

We agree to share all the costs of mediation equally between us.

We agree that neither of us will commence legal action until, in the opinion of the independent mediator, the potential for negotiation and mediation have been exhausted.

(iii) Non-Disparagement
If a dispute arises, we all agree that we will not engage in any public discussion about the issues, we will behave politely towards each other, and we will avoid any conduct or communication which might reasonably be expected to unreasonably interfere with any other person’s business or personal interests.

(iv) Jurisdiction
This agreement is subject to the governing law of Victoria, Australia. Regardless of where you live in the world, you irrevocably agree that if the dispute resolution processes fail, the courts of Victoria, and the Commonwealth of Australia, will have exclusive jurisdiction.
